Apparently Canadian Maico took SoCal Maico to court and has won for breach of copyright and the wrongful use of the name (MAICO)
and made them pull the plug on the website  :o
Can you believe it.
Bit worried about this cause I own 2 Maicos and get my parts off Les at VMX Unlimited.
Will Les be in the firing line next ?
I hope not,dont really wanna deal with anybody else.

John Caldwell (Canadian Maico) has apparently registered two Maico logos in Canada and the USA.  It shouldn't affect Australia and I think a company in Germany owns the rights in Europe.

I have already noticed one US site that hasn't got any Maico logos up.

While I have learnt to never say never, it is very very unlikely I will ever buy anything from Canadian Maico.

He may have registered the rights to some logos but morally does he own them?

Wasp  Are you in Australia??  I thought he had the rights to North America.  I think http://www.ktm-koestler.de/en/maico-bikes/maico-shop/ (http://www.ktm-koestler.de/en/maico-bikes/maico-shop/) have the rights in Europe.

You can always hotlink the logo to somewhere like photobucket and then its not hosted by your host  ;)

Yes we are in Adelaide , but he has a go at anyone using the logo on a website . He complained to Directnic  , so we changed host  , which we where in the process anyway , to launch  the new upcoming website . So the logo will stay .

It would be interesting to know if he as sent letters to Maico Only or Bill Brown in the UK or http://www.ktm-koestler.de/en/maico-bikes/maico-shop/ (http://www.ktm-koestler.de/en/maico-bikes/maico-shop/) in Germany.  To my knowledge Koestler owns the name in Europe.  Maybe ask them if you can use the logos.

There will only be one winner in all this and that is the Lawyers.

Wasp.  I would be interested to know.  When you know who sent you a letter, was it asking you for money to use the logo or just saying you can't use it full stop.

Also has any other owner of a logo (Yamaha, Honda etc, etc) ever said anything about using their logos.

Usually they don't worry about it Kev, as it's all FREE advertising they get....imagine if the graphics guys had to pay a fee for every logo they use to put on bikes.

Yes but, you know who, apparently wants to control everything Maico.

Anyway the only time I ever had a problem, expressed from someone, was when I sent the graphics for a program cover to Yamaha Australia (Qld).  I was told the tuning fork logo was upside down (apparently a common problem).  Anyway it resulted in the cover front and back and inside being sent to Yamaha's graphic artists and being done at their cost.  Sometimes it pays to ask.

They appear to be spending a lot of money to make the lawyers richer.

I have noticed some of the companies in the US no longer display the Maico logo.

It really is stupid, don't they know that this is the whole M Star saga again, something that in my opinion contributed to the demise of Maico

Fighting over rights to things can result in all sorts of stupid things occurring, just ask Mike Goodwin.

Logos and name still there.

Canadian maico got me pulled off eBay for selling aftermarket maico parts by going to eBay and telling them I was selling counterfeit parts. Even the parts that I invented and made for a maico that maico never made was pulled off. I had made some drawings of a new clutch guide plate for the clutch, big and small clutch that would have (I think) made a world class clutch. It will never be made now because of what is going on with Canadian maico.....I have sold all my maico stuff and moved on to other bikes.....so who got hurt in all this? you the guy that rides a maico.....I will never put a cent into making a part for a maico again. You can thank Canadian maico for that! I don't know what John Caldwell is trying to do....but from were I sit it's not helping the VMX community and helping one another is what I loved about this hobby.

So, it is just the Maico logo and not the name Maico?  I own a famous VMX logo, but I would never stop others from using it.  I just wanted to protect myself from the previous owners, if I decided to use it commercially.

It is interesting that of the two trademarks JC now owns, the second one only became available on the 2nd April this year.  It was in the name of a holding company in Germany. 

The trademarks are also for motorcycles, structural parts for motorcycles.

BREAKING NEWS on the Maico logo front.
Canadian Maico's lawsuit against SoCal Maico and myself was thrown out of Federal Court and the Federal Judge dismissed the lawsuit. The Federal case is done and over with.
We are now back at the United States Patient and Trademark Office (USPTO) as the Petition to Cancel Canadian Maico's registration of the Maico logo as been resumed. This is the exact place we were at 2 years and thousands of dollars ago. Nothing has changed because of the lawsuit. The whole thing was a complete waste of time, money and was a real sham from the beginning.
I want to thank all that have voiced their support through this whole mess. It has been a long two years.
It's odd how all the Maico businesses play nice with each other except one.

That's good news knowing that JC lose holding the right to Maico logo and I hope it sticks.  I appreciate having more companies building/selling Maico parts rather than having Canadian Maico being the only business that we all would have to deal with.

Several years ago I bought one item from Canadian Maico (a 490 piston kit).  I decided to return the piston kit due to its piston being heavier than a Mahle piston and he refused to take it back!

It would be nice to get the Maico name back under the ownership of one company or group of enthusiasts.  As it stands now any attempt to revive the name can not succeed because different people own the rights.

I think the Indian and Norton names went through the same thing.

Well...I'm sure we were referring to using brand name for aftermarket parts not as a motorcycle manufacturer.
