Right of redress thru Ebay.

Is there any right of redress, refund, through Ebay or Paypal if a seller completely and dishonestly misrepresents the goods?

I've just had my frist bad experience through Ebay. This is not a near miss but a complete and intentional rip off, scam.

YEs thereis you should be calling them direct - ebay that is, although having said that Ebay a useless, guy at work just bought some Bikecycle cloths all where rags, pay pal told him to post them to an address ( turn out to be the seller) he wont accept them back, paypal/ebay goes without a reciept of acceptance too bad. So he has paid for a pile of rags he no longer has, 2 lots of postage and so far ebay has done nothing but make excuss and waste his time on the fone and its been 2 months now.   

Ebay seem to be attracting more arsehole and rip off merchants, i keep hearing and have experianced it myself where low lifes keep trying to scam every little 50 cents they can, im so over it.  where have all the good people gone ?  back to garage sales and swap meets i think.   till ebay sort those peanuts out.

All you can do is leave feedback as a waring to others, and keep ringing ebay and paypal until they refund you.

I'm obviously aware of 'buyer beware' and I take the normal percautions and/or I'm prepared to be philisophical if I take a risk. But this is just blantant misrepresenting by words and photos.

I would have thought it was in the interest of Ebay to be absolutely aware of the potential of misrepresentation and to stamp on an proven cases of blatant misrepresentation. Bad experiences will just turn people off from the whole electronic shopping and they will be the losers. I Think that misrepresentation is the cancer that can kill the goose.

My current experience, which is still evolving, and the experience of your friend will be enough for me to be a lot more guarded and therefore using Ebay less. Therefore Ebay loses. If misrepresentation becomes widespread you could mulitply my responce by 10,000 or 100,000 or even 1,000,000 world wide and Ebay will loses significantly.

I was recently Ripped off over an Ebay deal with a Forum member, The person totally misrepresented the part he was selling .
When i questioned him he became an arrogant & abusive prick .  

 I have a number of emails from the seller including one that states "he is getting out of the old woman VMX scene " yet i still see him posting on the forum witch usually involves advertising his Ebay items.

Ebay and Paypal leave me no right of return so i will put it down to Buyer beware and that i believe what goes around comes around

It's diffcult when it's a misrepresentation. I was completely covered by Pay Pal when I had a problem, but that was clear in that the parts was never sent. Good luck mate.

E74, I have seen the emails, and I was surprised at how arrogant this person become, not only was he rude but insulting.

The guy has generally good feed back and sells a lot of Nos Yamaha stuff
He sold me a MX 125A optional chrome bore cylinder Described in good usable condition . when it arrived the chrome is lifting off the Cylinder in a number of places and needs replating.
I won it for $71.00 + $40.00 post & packing witch if it was as described would have been cheap.
The Problem i have with the guy was the arrogance and shit attitude, i will get the cylinder plated and use it but why missrepresent somthing . He must have known it was unusable witch would account for his anti response when questioned.

but I will comment on this, I have spent in the proximity of $300,000 on ebay over the past 5 years..... and out of that I reckon Ive been dudded about $2000, not bad odds concidering I have obtained the unobtainable , met hundreds of the most obliging, honest human being's on the planet, and in that made some solid freindships and engaged many fellow enthusiasts, so when I look at it in that aspect, I'm miles in front!

My issue is still evolving. I'm just trying to get ahead of the game somewhat by knowing my next potential move if it comes down to it.

The guy I'm dealing with is known within the VMX scene. My initial contact was ebay message and then m/phone when he didn't respond. On the m/phone it was 'less than statisfactory' with him been what I would call rude and arrogant, denying everything and hanging up. There's been subsequent ebay message with an offer. I've responded with some questions about costs.

I'm not sure if he's a forum member or lurker or not. If this deal turns truly sour I'll do everything within the law to name, shame and forewarn. I hope it doesn't come to this, its suppose to be a hobby for all of us, buyers and sellers.

Its disappointing so far, let hope it just ends up being 'crossed wires'

I agree absolutely and wholeheartedly with this point which is why I said perviously that I would be more guarded in the future. But I must admit I thought I was being fairly guarded dealing with and trusting a fellow Aussie VMX'er. My bubble may have just been burst. I'll wait and see, and hope.
