Piston Problem

Hi Guy's
           I bought a NOS piston on eBay for my 74 CR250M,which arrived today,but it has a small piece broken off the bottom of the piston skirt. Will this have any effect on it's abillity to be used,should I make it smooth and fit,or do I complain to the seller and see if he will replace it? It came from England,so to return it's not that easy and it is only a very small piece.   Any thought's?

If the add failed to state the piston was damaged and sold as NEW (NOS implies it is such ). I would be straight on to the person that sold it to you. If they want it back they should be coming to the party on freight costs too.  >:(
