Title: Another Ebay Scam to be aware of.

Well kids, it’s certainly buyer beware in Ebay land!
I’ve just sold an item, which went to India of all places. Buyer took 12 days to pay with one communication 3 days after the sale to say he was paying, then nothing. When he did pay it came with the message “We’ll wait until the 5th July for delivery” WTF?
Item posted by Registered Post with the Delivery Confirmation option.
Posted on the 14th June.
Last night (6th July) the buyer opens a “Item not sent Case” and this morning Ebay refunds him $428.00 out of my account.
WTF!
Ebay’s only response:
Item not sent with tracking number. Not withstanding the time frame allowed for postage does anyone else think this unreasonable?
I'll try and talk with Australia Post about what happens re the Delivery Confirmation, but.....

If it was sent registered then he has to sign for it so Aus post should have the records.  That will give you proof for ebay.

I have noticed some sellers that sell worldwide exclude certain countries.  Italy's a popular exclusion  because of their dodgy postal system.

Did the buyer pay with Paypal? was it your Paypal account that the funds were withdrawn from?
If so, Paypal as well as Ebay should have contacted you about this issue and you need to contact them (Paypal) via the response email address in the message they sent you or through you Paypal account resolution page and provide them with the tracking number and also scan and send via email a copy of the con note. Also send them and Ebay, the message reference number the buyer sent you and highlight to them that it contains information that is contrary to Ebay policy i.e. the threat of action if item not recieved by buyers demanded date. Ebay gives up to 45 days to pursue this action so why the rush by the buyer.

Registered Post International is for items less than 2kg and your customer copy of the con note should have a barcode with the tracking number written underneath it

and type in the tracking number you should get some idea of where the parcel is in the system.

It was sent Registered and someone does have to sign...I've told ebay that in my [vain] appeal against the case. Yes paid by Pay Pal and funds then with drawn from Pay Pal, no contact from Pay Pal at all yet.
Yes they corresponded alright..within hours of my reply I got this.

Have contacted Oz Post Customer Care, who have told me today that "item has been processed and on route to destination"
Turns out the customer (me) can't track Registered Post international...but Oz Post can.
The onus is now on me apparently to ring India Post tonight and report back to Customer Care tomorrow. Tried to ring Ebay and got an "emergency shutdown" message. "No one available - Thank you - Goodbye"..clunk.
What is really pissing me off like you won't believe, is the fact that the buyer has set the rules for delivery date and Ebay has simply agreed with him and totally ignored any plea from me. >:(

So to avoid this, do sellers have to send the tracking details to ebay somehow? I dont like the idea how they can just pull back the money from your account and still get the goods.

Well there is a box where you enter tracking info for your trade...which I did. But apparently if either you or the trading partner can't access and use this then it won't be accepted as a tracking number and your deemed to have not sent the item as it can't be tracked......I can feel the blood pressure rising and the shakes beginning as I type this.  >:(
Even though it can be tracked by Australia Post this friggen system has let me down big time.
I believe you MUST send Express international for the trading partners to be able to use the tracking facility.

I'd be taking a trip to india to get some money it would cost you more but you could get the slimball you had the address and name right.

Just to complicate things a little more. It won't matter if your parcel leaves OZ with a tracking number. Unless the country of destination uses the same bar code system you won't be able to track it. The item will only be tracked as far as leaving OZ. When it gets to the country of destination and after customs has finished with it. It gets handed over to their postal system. They then re number the item and send it on. No records are kept of the original number so you won't be able to marry the two up. the item will be signed for by the recipient but you won't be able to prove it was your item. They can just say they didn't get it or the item they signed for was a diferent one.
Just to add insult to injury, the new number they put on the parcel will probably be for their cheapest recorded service. Even if you could prove it had gone missing the compensation paid out would be minimal.
The thing to do is to check with OZ post and ask if the item will be tracked to its destination using the same tracking number. If not use fed ex or ups at three times the price as they use their own system door to door.

What did you sell?
Alarm bells would have been ringing for me if it was bike parts to India.

I was under the impression that confirmation wasn't part of the deal, and that you only needed proof that it was posted as the rest is out of your hands.


I also suspect that they won't sign for it as they don't actually want the goods, they just want the paypal money.

I would threaten legal action as this all sounds like it is outside of normal policy

Ebay is geared to the buyer. Works fine most of the time, but when you get a dick buyer, its really crap.

Some months ago, the wife copped a split personality nut-job who caused us a ton of grief.
Short version is that his courier had picked the item up, but Ebay were going to refund his money to him simply because the "Item not Received" claim was about to expire - and Ebay didn't give a f#$k about the details leading up to it. Even got told by Ebay "live help" that we should just refund the cash to him, 'cause they were going to do it anyhow...
Luckily, the item got to him when he was in not-totally-insane mode, and he closed off the dispute hours before Ebay were going to f$%k us over.

If you are about to get reamed can you close your paypal and ebay accounts so there's no access to your bank before they try to take funds?

The item was a coin set (Don Bradman  8)) To help pay for my project Z1.
The buyer actually has 300 odd trade history all positive, though at least one positive feedback talk of extremely slow payment.(another ebay glitch...leave negative feedback only if you want retaliatory feedback to your account)

This is the bit that's got me F***ed! I've actually rung Ebay (Oz) twice now. First time I was told to ring back and they'd "look into it in the meantime" and put me onto the decision making team if I ring back, which was today.
Rang back this afternoon, had to go through the whole rigmarole again was then transferred to the relevant dept.....which turns out is in the US and got the out of hours message and cut off. Rang back again, and told yes it's in the US you'll have to call back (yet again) tomorrow at 9 we'll transfer you then.  >:(   
I've suggest ( and firmly believe) that this must be at the least borderline illegal? This is BS  >:(
I've basically had my account raided and been defamed on a global scale with his Neg feedback, and all with absolutely no request for the postage documentation ( I can't even get them to provide an email address where I could at least send a scanned copy) .
Oz Post Customer Care also suggested the 45 day time frame.
I'll see what eventuates tomorrow, but if I'm brushed off then, I'm not sure what comes next?
Suck it and get on with life, spend a shirtload of cash on legals or maybe just try Fair Trading.

I sent what I considered all the relevant information I could think of to support my case....and zip! Exactly as you say, they either didn't even bother to read through it or just take the easy option and "next case"

Thats what a lot of US sellers say. 'Once its posted its out of my control and im not responsable' they all say

I bet if you take it to Today Tonight or A Current Affair that ebay may wake up and listen ;)

probably why most businesses in the Usa send priority mail to here, it's dearer,but you have to sign for it when you receive it,i send a fair bit of glass stateside,with minimum insurance mainly as a tracking aid,oz post has reciprical arrangements with USA with tracking,but many other countries oz post will not guarantee,or insure parcels to,Canada,(shiploads go missing apparently),& germany are 2 i know of,i'd be having a talk to fair trading,see what they suggest, :P

So, just got off the phone to Ebay US (More expense and time) Told that Ebay has NO choice but to found in the buyer favour!! They now have record that the item has arrived in Mumbia - India, but.....It hasn't been delivered to the buyer, for what ever reason.
I was told that regardless of this I am responsible for delivery...NOT Australia Post or indeed India Post!
"The buyer must complete delivery to the seller"
Ebay say they have no system to be able to change any outcome to their decision unless the buyer receives the item....and then!..get this! It's my responsibility the request payment again from the buyer ie: they can't simply pull moneys from his account as they have from mine...."we don't have any facility to do this" well, only to me it seems.  >:(

Now, my head just keeps telling me that this can't be correct (or lawful surely)
Last night I swallowed a lot of pride and sent another contact to the buyer which resulted in brief exchange of restrained emails, the final from the buyer being
"I am ready to work with you. Do not worry. At the moment things are out of your control and my control so lets keep the fingers crossed"
Which while somewhat heartening, had no sway what so ever with the A-hole at Ebay.
Guess I can only wait for the result of Oz Post inquiry on the 13 July.

Well apparently not! From what I've just had shoved down my throat, if your a seller then yes, you ARE responsible for the safe delivery, or else take it up with your shipper 'cos Ebay won't.

No O/S shipping, or either that send with UPS or some other completely trackable alternative. Problem is that is usually cost prohibitive. At least the buyer appears to be willing to work with you. Bummer, hope it all works out satisfactorily for you.

MX . I take it you have you credit card details added to  your pay pal account , hence they can take money from your account.
For me I have a limited amount of money sitting in my  Pay pal account for this various reason.

A bit old ,   Ebay - Pay pal - skype -   Seem to be doing it tough eh .

The company in general makes it so hard for you to make contact to resolve any issues .... and they seem to be the judge jury and prosecuter all in one.

How do you do this, just transfer an amount to it? don't you need to save account details to their site, like you do to transfer funds out of Pay Pal.

Yeah as far as i am aware you cant set up a pp account without a credit card number or bank acc number.

i think what old fart meant was , the same as me, i have a credit card just for my paypal account, i only put the money in that account that is required for any purchases made via paypal.

Dave your on to it. ;) It has a limit attached to the card pre arranged with bank and will not give  credit when this amount is overdrawn. I just top this up when I need  to add funds

Are you sure they can't raid any parent account? Wonder what happens say, in my case with this type of card? Do you reckon they'd just roll over and accept that?

Yep i have a Visa debit card. You can use it to make purchases where ever you would normally use a Visa credit card.

I recently purchased a cylinder, piston and rings from a reputable USA seller via Ebay. When the parts arrived they were nothing like what had been described in the auction. The cylinder was listed as a Suzuki TS125 hop up cylinder and photo's in the auction confirmed this with a photo in the auction showing a larger inlet and exhaust ports compared to the standard cylinder.
What I received was a standard TS125 cylinder, late standard TS125 Piston (wrapped in bubble wrap?) with a single hole on the inlet side and a set of rings in a blister pack to suit, I guess, this piston.
I contacted the seller who said to send the items back and the correct items will be shipped. I also lodged a "not as described" resolution with Ebay to make sure I had a bit of insurance if the seller claimed not to have received the returned goods.
After spending an additional $87 to send the items back and two emails in which the seller assured me they would send the correct goods upon return of their mix up I am out of pocket for the return postage although Ebay has refunded my purchase cost including postage.

To say Ebay and Paypal is geared only towards buyers is wrong as I have been burnt as a buyer with the same system.

The problem is that it is too automated and acts before humans can intervene in the automated decisions created by their computers. Fair Trading should act to stop this as I am sure it does not meet with consumer law.

I have a major problem with Paypal currently, and looking at closing my account because of it.  Because I work overseas for extended periods of time Paypal picks up that I have made a payment from my account from overseas and not Australia - so randomly (but often) the Paypal system rejects the payment leaving me stranded.  When queried about this I got the news that I can only use Australian Paypal in Australia (news to me) and that the system couldn't be changed because it was automated.  All of this after chasing a phone number for hours because it certainly isn't readily available from their website.

Maximum profit all right, in the Billions. To me it's all about making it hard for the consumer to make contact in person.
Traily has a fair point , does this meet fair trading practices .... computer generated decisions

Well, this story has more drama than the Soaps ::)

Around a week ago Oz Post finally got back to me.....

"I refer to your enquiry......a thorough investigation has been conducted. Unfortunately, our efforts to locate the item were unsuccessful....blah, blah."

So OK I thinks, and file a compensation claim. I didn't insure for extra, so max. is $100 + postage costs.

Friday I get a call from Oz Post.
"The copy of the receipts says you sent a coin set".
"Yes" I say.
"It's not legal to send a coin set international, so we won't be able to pay any claim" She Says.
"Well when I posted it I wrote on the Customs Notice....COIN SET. Why didn't they tell me then?". I say, barely containing my frustration.
"I doubt we can pay it, but please send a copy of the Customs Notice, we MAY review it"
"Don't you have the Customs information" Still trying very hard to be civil.
"No" She says.
 >:(

So this morning I fire up the 'puter to scan the Customs Notice and bugger me but here's an email from the buyer.

"Hello , please contact me, your set is trapped willfully by customs.
Regards"

Bloody hell! >:( >:( >:(

So now I have to send a declaration saying it is was a  sample only and then they'll release it and send it back to Australia.

Things may have a happy ending after all, and it says a lot for the integrity of the buyer as well.

Good to hear that it may work out in the end. Providing there are no more twists and turns.

I recently sold a potbelly stove on ebay for $340.  No contact from the buyer, so I sent a email stating that it would be re listed. Immediately got an irate phone call from buyer about my rudeness.  She then arranged to come and pick up the stove in ten days.  Get an email that morning that they're on their way.  Then no show.  I file an unpaid item claim with ebay, when I close it I find that I can't leave feedback for the buyer, but, the buyer can leave feedback for me.  So they can give me a neg, but I can't give them one.  Ebay said that bidding restrictions would be put on their account.  So 3 weeks have passed and I still had this potbelly stove, so I get a can of VHT give it a quick shot put it back on ebay and it goes for $760, felt like emailing the original winner and telling her to suck pus.

Geoff...I think you'll find that email to be legitimate. The sender is my uncle Wine who has recently taken over the family's brewing interests in Nigeria. I speak to him regularly and know that if he's signed the form, it has to be right. I myself was recently left around 200 million American dollars in Uncle Wine's wifes will. The cheque is apparently enroute as we speak.
